SterlingONE will remain online during the maintenance window, however clients may experience intermittent connectivity issues at that time.
Many customers have been receiving Monitoring and Compliance emails from the Department of Homeland Security regarding TNCs.
The notifications E-Verify issues are generic templates, which do not populate the list of impacted cases, and do not discriminate by access method (e.g., direct users vs. web services users). Any directive to log into E-Verify should be understood to log into a user’s E-Verify access method – which would be the vendor platform for web services users, or SterlingONE.
The E-Verify Monitoring and Compliance notices are based on case(s) that DHS identified as cases that:
It is not possible, either in E-Verify directly, or in SterlingONE, to refer and further process a TNC without indicating that the employee has been notified. The only use case that would allow a user to act on a TNC case without indicating that the employee had been notified, would be if the case was immediately closed. There are a number of valid scenarios where a case in TNC status may be closed without needing to notify the employee, including, but not necessarily limited to, a case that was identified to be invalid due to incorrect data. In these instances, it would be appropriate to close the TNC without needing to discuss with the employee, and resubmit a case with corrected data.
We have discussed this scenario with the E-Verify Monitoring and Compliance team, and they have suggested, based on the volume of these notices being distributed, and the volume of calls they are receiving from E-Verify enrolled participants – not just Sterling client companies – that employers should not assume they are out of compliance without reviewing their case history.
Employers who receive an E-Verify Monitoring and Compliance notice may call E-Verify and ask to speak with the Monitoring and Compliance team for a list of cases tied to the notice. E-Verify can be contacted at 888-464-4218. Employers will need their company ID and will need to be listed as a POC for that account. Employers can also review their case history using their E-Verify access method (SterlingONE) to identify cases likely related to the notice.
To identify cases, navigate to the E-Verify Case Management report under the Onboard tab of SterlingONE. Un-check “Show me actionable reports only” and search by E-Verify Final Result under the Advanced Search Options for cases resolved as invalid or employee termination/TNC closure results.
Based on the case resolution, it may have been necessary to resubmit a new E-Verify case for successful processing. Navigate to the candidate record (clicking on candidate name in E-Verify Case Management report) to confirm if a subsequent, valid case was processed. It is recommended to document that a subsequent case was submitted and cleared on the original I-9 record. This can be done by adding a Status Note in the original I-9/E-Verify report in SterlingONE.
